AZBTR STATEMENT

Date: August 7, 2025 From: Rachael Collins To: AZBTR Board This is my summary statement to the AZBTR Board. I have had to discover, collect, print, analyze and organize the hundreds of pages of documents I've shared with the Board of AZBTR since i filed my complaint in January 2024, as I was able to find out about and acquire them. The truth of the situation of what Patty Luttrell has done is irrefutably evident and yet I still don't know ALL of it yet. Here's a quick snapshot of the situation I was in before hiring Luttrell that is very material to this case. I am a master degreed ivy league professional who was a consultant to CEO's of large brand name companies and start-ups in my career of 20 years before I was disabled by a drunk driver. I then spent 18 years recovering from very serious injuries that were rare and difficult to treat while I turned my attention to investigating serious social injustice issues. I survived against all odds but suffered continually through that period of time 2004 - 2022 and went through a million dollars of my own money for the many treatments that kept me alive but weren't covered by insurance. Although I was still disabled, it meant everything to me to be able to get back to the work I loved and make an excellent income again when I rented the office at Aspen Ministorage in Cottonwood. And in an incredible situation of more negligence, I was contaminated in that office by metallic copper slag dust from a slag refining operation located behind the property I leased on that my commercial landlord never told me about, although he KNEW that almost everyone who lease his offices and 600 storage units is exposed to serious contamination there - and has admitted it publicly since. I realized I was being lied to by him about the black dust on everything in my office and storage units and why I became sick. I hired Luttrell because I needed the absolutely most qualified consultant I could find for an environmental contamination case that no one knew anything about at the time I hired her. There had been much collusion among the many powerful parties making money from this operation so I needed to acquire irrefutable legally defensive lab analysis of the slag dust in my office. Luttrell purported to me that she was an environmental consultant, licensed geologist and industrial hygienist with 50 years experience in analysis of many sources of environmental issues. She told me she had testified in Court before and could do so for me. I thought I had certainly hired an excellent credible professional and it never entered my mind that I couldn't trust her. As you have reviewed in my documents, Luttrell charged me $3,250 for the collection lab analysis of one slag dust sample from my office that she collected in late December 2022. She made many serious errors in the first two pages of her draft report that I believe I received in March, 2023 and I asked her to make the corrections, which she balked at doing. I did not get a final report from her with all appendices until September 2023 which is obviously NOT a reasonable amount of time. For comparison, I have had many sample analyzed by the same lab in Phoenix that analyzes MRI's (the refining company) own slag dust annually and I am charged $300 for a full analysis of 15 metallic elements. The results of the lab analysis Luttrell gave me did not include the metallic elements she KNEW were in the slag dust from her own review of MRI's materials data sheet and yet Luttrell claimed to me that the results "proved" my office was contaminated by MRI slag dust. It did not. I still have no idea exactly where she took that outside sample from and why she mixed it with the sample from my office. Her final report that took me 9 months to get from her is not remotely useful nor legally defensible and I could never submit it to an attorney or a Court of law as being legally defensible because that would be a LIE. I believe that in her defense, Luttrell will still maintain it's a legitimate evidence report which would be another disturbing situation. I would be appreciative if the AZBTR Board asks Luttrell to prove that she knows what legally defensible evidence is and how many times she has been deposed in court presenting evidence she was responsible for analyzing as an environmental consultant. In addition to spoiling the evidence from my office, in late April 2023, I had an agreement with Luttrell to take 13 slag dust samples from other locations for other victims impacted by this contamination on their residential property or in their possessions at leased storage units and also on the ground in areas around the vicinity of the slag refining operation. At this point, I had no idea about the deception, collusion and damage Luttrell was about to cause me and other slag dust victims. I held a fundraiser in early May to acquire a portion of funding for this second project of Luttrell's although we had not agreed on pricing for it yet. For some reason, when I did get a proposal from Luttrell after the samples were collected, she was charging me appreciably more for her time to do collection, travel costs from Flagstaff even though she scheduled those two trips with personal visits in Cottonwood and her proposal was not detailed about how the lab analysis would be handled. At no time had I directed Luttrell to analyze the samples herself since she is not a qualified laboratory and the results would be useless and not be legally defensible. If I didn't trust Luttrell at the point we agreed to do the second project, I never would have invited her to the small meeting on June 26, 2023. The 4 attendees (Keable, Sina, Richards, Conway) all purported to be able to help me in many ways but were given very limited information by me because i didn't know them. ALL were very clear that everything they learned and my entire investigation (even that I was doing it) was highly confidential. Emails show that I re-iterated this over and over to ALL of them. I was minimally acquainted with Richards, Sina and Conway for less than three months because of their 'hit and run' theft of my investigation. At my meeting, Richards did 90% of the talking, presenting information she had learned from a records request of the City of Cottonwood that she did of her own initiative, clearly with a personal agenda I now know. I did not let Luttrell present results of her report on my office. I had invited her because of the second set of samples she had already collected and the fact that the attendees claimed they had enormous financial resources to help pay for the testing. 3 of them are millionaires including Conway who also had the resources of the Children's Health Defense non-profit she was and is the Arizona President of. In the meeting, I was blindsided when Luttrell spoke and said she had mixed the slag dust sample from my office with a slag dust sample she took "outside" my office. She certainly never told me she was going to mix my clean sample with another sample and I would never have agreed to that because it obviously contaminates my sample. My emails to the groups attendees after that meeting confirm I was shocked and just learned about it at that meeting and because of this and other disturbing things Luttrell disclosed, I could not plan to continue working with her as my consultant. The introductions made with attendees at that meeting seem to be the initiation of the subversive and depraved collusion between those parties and Luttrell to give my evidence report to them. Although I still know only a fraction of the truth, (including that possibly Richards had contacted Luttrell without my knowledge at some point in time before that meeting) I have evidence she was sharing at least some of the 13 samples and lab results with Jennifer Richards and Shaida Sina but I and the victims on whose behalf they were collected have NEVER seen the samples or lab results. I do however have the photos, videos and the log of every property that I attended during Luttrell's slag dust sampling My case against my landlord and City of Cottonwood for serious irreparable damage to me has been seriously delayed. Richards had advised me in emails NOT to attempt to hold anyone accountable or seek reparations for my damages, while it turns out she was trying to drum up a class action lawsuit for the community against MRI. Richards' subversive and unauthorized submission of my report to City officials was used by her and Dr. Sina to make very serious false claims to City officials using my report as their "evidence". By the time they did this, they knew it was not a defensible environmental analysis or report as my emails with them prove. Richards made public claims that she was compensated by City of Cottonwood officials through settlement of a prior lawsuit she had against them. Their fraudulent scheme took off like wildfire fueled by their continual public speaking engagements, social media that used material stolen from my copyrighted private website to create and completely unsubstantiated allegations made to City, County, State and federal officials. Their criminality and the damage they have done could not be more serious. Richards and Sina, conspiring with Conway and Luttell, perpetrated their fraudulent scheme against an entire unsuspecting community who have now been deprived of knowing the truth about their potential and unproven exposure. And the perpetrators have profited significantly from their scheme while victims still have No compensation. Dr. Sina suddenly claimed to be an environmental medicine doctor and solicited sick people in the community to come to her office for very expensive testing and treatment not covered by insurance which has kept her very busy for two years to date. Richards continues to make claims that her son is sick from arsenic exposure in Cottonwood Kids park and seek compensation from the City of Cottonwood for that, even though she and Dr. Sina didn't even know there was a slag processing operation or even a mining history in Cottonwood when they intruded unsolicited on my private investigation and destroyed my life. Despite their initial sudden invasion of my case and promises to help me and other long-term slag dust victims when I was extremely sick and burned out, Richards and Sina instead sabotaged me while they knew actual victims would continue to suffer and degraded physically, mentally, emotionally and financially. In the email evidence I am reviewing currently from the City of Cottonwood, in June 2023 Richards was demanding the City give her access to the remediation fund provided to the City by MRI. She claimed repeatedly she knew about people sickened by the slag dust and needed to help them. But she didn't even communicate with, let alone help ANY of the real victims. She just exploited having knowledge from me that they existed and had complained to the City for years as the basis for HER attempts to profit at our expense. Even more diabolical, I and set up a non-profit for my fundraiser and had been raising money to help victims with their medical testing and Richards made sure that NO ONE would donate to it. Dr. Sina tried to rent a room from the City of Cottonwood to hold a meeting and claimed she was eligible for a non-profit rate through someone else's non-profit. In fact, that was a non-profit she had imported from another state and attempted to register with the AZ Corporation Commission unsuccessfully. To date, Richards, Sina, Conway and even a former County Supervisor they drew into their scheme, Donna Richards, continued to make sure that the true victims got NO help. This level of deception, manipulation and inhumanity is breathtaking and they enticed hundreds of unsuspecting as well as willing people to support their scheme. At this point, the perceived reality of the Cottonwood community is based on information so bastardized by misinformation and my reputation so destroyed by the perpetrators' gaslighting, defamation and unprovoked vendetta against me that the damage to the entire community and beyond and countless victims is permanent. One victim of slag dust contamination I was advocating for has been diagnosed with Berylliosis and Silicosis that she acquired living close to the slag refining operation. She is very poor, moved to another state and I have spent hundreds of hours working on acquiring specialty medical diagnosis paid for by her Medicaid insurance. She has been suffering horribly for years and It will likely be the cause of her death. But because of Luttrell's subversive actions, that victim has NO slag dust sample to be analyzed to prove the source of her contamination and so she has been deprived of the justice she had a right to and deserves. The 12 other samples were also very important evidence and those samples cannot be replicated. I would like this Board to ask Luttrell what she did with the samples, where they are, who she gave them to and why. At this point the irreparable damage is done and they would have to be assumed to be tampered with and contaminated as evidence. Luttrell and those she colluded with caused me include trauma so extreme that I almost committed suicide MANY times and victims I was representing also struggled with this as the evidence for their cases was stolen and they were deliberately hidden from public view and knowledge by Richards and SIna. Subversive narcissistic abuse is the most damaging of all crimes because the 'actors' causing it are excellent pretenders appearing to be credible and there's no defense against that. I needed specialized medical and psychological care for two years from the devastating knowledge they were assassinating my character and using my investigation while claiming it was theirs but the evidence of it was all kept from me and the other victims. They even colluded with a local mental health care provider I was getting life saving treatment from. She refused to give me my medical records for 6 months and when I finally got them she had scrubbed all the detail out of it identifying Richards, Sina and Luttrell and the trauma and damage caused by them as the reason I was suicidal and seeking treatment. When I filed a report against this psychiatrist with the Arizona medical board, she suddenly moved out of the country! I now have ZERO money or assets at 62 years old and disabled. I now have $10,000 in debt because of other slag dust testing I had to procure to replace what Luttrell was supposed to do and hired to do. I could not get back to work to make income. I lost my large house and all beautiful possessions I had in it due to the financial devastation that I suffered from extraordinary medical expenses of which the psychological treatment was thousands of dollars out of pocket. I have been living HOMELESS in my car for over a year! It's impossible to eat healthfully as I had done my phone life or have any quality of life. Imagine the humiliation and emotional trauma of being homeless and needing to admit this to be able to stand in line to get terrible food at the "poor person's" food panty and how not being able to eat high quality organic food as I did my whole life exacerbated my health issues from the slag dust contamination which have now proven to be very serious by three years of medical diagnosis and the news i am going blind from slag dust in my eyes. Living in a car has obviously seriously worsened my neck and back injuries that had stabilized enough for me plan to go back to work in 2022 after hundreds of treatments over 18 years. This is incredibly devastating to me! I am now re-disabled far worse than I was before Luttrell's destruction of my contamination case. Regarding my own right to justice for the contamination and damages I experienced at my office, Luttrell's collusion with other criminals caused me such massive damage that I am now 2 years behind where I intended to be in filing lawsuits and acquiring justice for myself. Defense attorneys for the perpetrators will likely claim I have missed statutes of limitations because of this (exactly what Richards and Sina wanted so THEY could profit from my investigation). If this becomes the case, then Luttrell and her co-conspirators are liable for ALL of the damages of my intended lawsuits against everyone including Aspen Ministorage, the City of Cottonwood, MRI and others. Luttrell had two $1,000,000 insurance policies at the time I hired her that I should be able to collect on but I have been so busy in medical appointments, reviewing the massive amount of recently acquired new evidence, writing legal documents and trying to survive that I have not yet asked the attorneys about this. It is literally a miracle I have survived this devastation but it's a mental, emotional, physical and financial struggle every single day and it's very tenuous whether I can hang on and continue to survive and for how long. If I die, (as Jay Adams told me he thinks he's about to) the story of Cottonwood Contamination is still going to be a national media story as I had always intended but now with EVERY detail of the criminal and malicious actions a group of diabolical people took against me and the fraudulent scheme they perpetrated against an entire unsuspecting community. In conclusion, the FACTS are that if Patty Luttrell had been a competent and trustworthy consultant I would have legally defensible evidence of the composition of over 15 heavy metals in the slag dust sample from my office in the Spring of 2023. If Luttrell had not engaged in a conspiracy to betray and damage me by giving my confidential evidence report to other people she had no right to give it to, I would have suffered NONE of this life destroying trauma, personal injury and permanent damage. The community would not have been victimized by people interested in their own intended fame, fortune and benefit because TO DATE, Richards and Sina are STILL using my report Luttrell gave them as their EVIDENCE to support their false claims and fraudulent scheme. And the actual very damaged and sick victims of slag dust contamination would have been helped by charitable people through my non-profit to get the medical help and justice for their damages they desperately need. - Rachael Collins
